1. General Information and Definitions

1.2 Consumer vs. Business Users

• "Consumer" (Verbraucher/B2C): Natural persons acting outside their trade or profession.
• "Business User" (Unternehmer/B2B): Natural or legal persons acting in exercise of their trade or profession.

2. Description of Service

KwilaLearn provides an online language learning platform offering courses in 11 European languages. Our Service is available in three account tiers, allowing users to try the platform before committing to paid plans:

Free Accounts (Tier 1: "I'm interested"):

All new users can access the service for free to explore the platform's core features. Free accounts include:

• Limited ability to create new lessons (translate and analyze new text) up to 1,000 characters per month
• AI-powered text translation and linguistic analysis
• Generate personalized learning materials including vocabulary and grammar exercises
• View learning progress and personal statistics
• Review vocabulary and grammar from past lessons
• Access and review previously created lessons and learning materials

Premium (Paid) Accounts (Tier 2 & Tier 3):

Users may upgrade to a Premium account at any time to unlock higher usage limits and full platform capabilities:

• Create new lessons from your own text (up to 5,000 or 10,000 characters per month, depending on the plan)
• AI-powered text translation and linguistic analysis
• Generate personalized learning materials including vocabulary and grammar exercises
• Full access to all platform features and personalized learning paths

2.1 AI-Powered Features

Our Service utilizes artificial intelligence to provide translations and analyze text.
Accuracy Disclaimer: While we use advanced technology, AI-generated content may occasionally contain inaccuracies and should be used as a supplementary educational tool.

3. User Accounts

3.1 Age Requirements

You must be at least 16 years old to use our Service. Providing false information regarding age constitutes a material breach of these Terms.

3.2 Account Security

You are responsible for maintaining the confidentiality of your credentials and all activities that occur under your account.

4. Subscription and Payment Terms

4.1 Subscription Model

KwilaLearn operates on a "freemium" model where users can access features via a Free Account. Users may upgrade to Premium subscriptions at any time to increase their monthly character limits.

4.2 Free Tier (Tier 1)

• Monthly Access: Tier 1 ("I'm interested") is free of charge.
• Immediate Access: Access is granted immediately after successful registration.
• Usage Limits: Tier 1 accounts include a limit of 1,000 characters for text translation and analysis per calendar month.
• Non-Transferability: Unused characters do not roll over to the following month ("Use it or Lose it"). The count resets to zero on the first day of each new month.
• Character Calculation: Characters are counted from the original text submitted, including spaces and punctuation.

4.3 Premium Subscription Fees

• Pricing: Tier 2 ("I want to learn") is USD $7.00/month; Tier 3 ("I REALLY want to learn") is USD $12.00/month (including applicable VAT/taxes).
• Immediate Access: Premium access is granted immediately upon successful payment processing.
• Usage Limits: Tier 2 includes 5,000 characters; Tier 3 includes 10,000 characters for text translation and analysis per calendar month.
• Non-Transferability: Unused characters do not roll over to the following month. The count resets on the first day of each new month.

4.4 Payment and Currency

Payments are processed in United States Dollars (USD) through secure third-party processors. By upgrading, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

4.5 Automatic Renewal

Your Premium subscription will automatically renew each month on the anniversary of your upgrade date. To avoid being charged for the next billing cycle, you must cancel before the renewal date.

5. Cancellation and Refund Policy

5.1 Downgrading to Free Tier

You may cancel your Premium subscription at any time through your account settings. Upon cancellation, your account will not be deleted; instead, it will be downgraded to a Free Account at the end of your current billing period.

• Access Retention: You will retain access to Premium features until the end of the period you have already paid for.
• No Future Charges: Once cancelled, you will not be charged for any subsequent months.
• Partial Refunds: No refunds are provided for partial months or unused character limits within the current billing cycle.

5.2 Right of Withdrawal for Consumers

In accordance with Austrian and EU consumer protection laws, Consumers have the right to withdraw from their Premium subscription within 14 days of the initial purchase without giving any reason.

To exercise this right, you must send a clear statement of withdrawal to Kwila Technology KG via email at contact--NOT-FOR-BOTS--@kwilalearn--IGNORE--.com . If you withdraw, we will reimburse your payment within 14 days using the same payment method used for the purchase.

5.3 Free Tier Access After Cancellation

Following a downgrade, your account remains active as a Free Account, allowing you to:

• View and review all previously created lessons
• Access your existing learning progress and statistics
• Review vocabulary and grammar points from past sessions
• Create new lessons or translate new text up to 1000 characters per month

5.4 Permanent Account Deletion

If you wish to permanently delete your account and all associated data rather than just cancelling your subscription:

• Use the Account Management function, navigate to the Security tab, and click the Delete account button.

Please note that account deletion is irreversible.

6. User Conduct

Users are prohibited from submitting content that is:

• Illegal, harmful, or promotes criminal activity
• Hateful, discriminatory, or contains hate speech
• Sexually explicit or depicts violence
• Misleading or constitutes spam

7. Limitation of Liability

For Consumers (B2C):

Liability is not limited for death, personal injury caused by negligence, fraud, or breach of core contractual obligations (Kardinalpflichten).

For Businesses (B2B):

Total liability is limited to the amount paid in the twelve months preceding the claim.

8. Dispute Resolution

These terms are governed by the laws of Austria.
